1.1 Ownership and use

Your use of Digital Craft is governed by a legally binding agreement between you and DIGITALCRAFT Sp. z o.o. This agreement consists of these “Asset Store Terms of Use”. By ticking the box confirming your acceptance of these Terms and/or registering as a Digital Craft user, you agree to these Terms.

1.2 Asset licensing

In addition, every asset licensed through Digital Craft – whether developed by DIGITALCRAFT Sp. z o.o. or created by a third-party creator/supplier and supplied to DIGITALCRAFT Sp. z o.o. for distribution – is governed by the standard End User Licence Agreement (EULA) of DIGITALCRAFT Sp. z o.o., which forms an integral part of these Terms and is set out in Appendix 1.

DIGITALCRAFT Sp. z o.o. acts as the seller and contracting party vis-à-vis the end user for purchases made through Digital Craft. Third-party creators and suppliers provide content and the necessary rights to DIGITALCRAFT Sp. z o.o. under separate contractual arrangements and do not become a party to the sales contract with the end user merely because their asset is made available through Digital Craft.

By ticking the box confirming your acceptance of these Terms and/or registering as a Digital Craft user, you also agree to the EULA. Individual components of an asset may additionally be governed by applicable third-party licences where expressly indicated in the asset materials.

1.3 Use of assets

You may use Digital Craft to browse, search for and download assets. Assets include software designed to facilitate the development of electronic applications and digital media, such as computer graphics (including 3D graphics), sounds, music, tutorials and other digital materials created for integration as embedded components of electronic applications and digital media.

Some assets may be developed directly by DIGITALCRAFT Sp. z o.o., while others are created by third-party creators or suppliers and supplied to DIGITALCRAFT Sp. z o.o. for distribution through the platform. Regardless of the origin of the content, where a purchase is made through Digital Craft, DIGITALCRAFT Sp. z o.o. is the seller and contracting party vis-à-vis the end user.

DIGITALCRAFT Sp. z o.o. is not responsible for assets obtained from sources other than Digital Craft. Some assets may be free, while others require payment. You are responsible for paying for orders that you place through Digital Craft, subject to mandatory consumer rights and rules concerning unauthorised transactions.

2.2 Payment methods

DIGITALCRAFT Sp. z o.o. may offer different payment-processing methods for purchasing assets through Digital Craft. By using a particular payment method, you agree to the applicable terms of the relevant payment provider.

You agree to comply with applicable tax obligations that lawfully apply to you in connection with your use of Digital Craft or acquisition of assets. Nothing in this provision transfers to you taxes that DigitalCraft is legally required to collect, report or remit.

THIRD-PARTY SERVICES AND COMPONENTS

4.1

Certain components of assets – whether developed by DIGITALCRAFT Sp. z o.o. or originating from third parties – may be governed by third-party software licences. Where there is a conflict between this EULA and such a third-party licence, the third-party licence prevails only with respect to the specific component to which it applies.

CHANGES TO THE TERMS

10.1

DIGITALCRAFT Sp. z o.o. may amend these Terms from time to time due to changes in law, service functionality, products or business processes. The updated version will be published on Digital Craft with its effective date.

Material changes apply prospectively and do not deprive a User of mandatory rights already accrued in relation to earlier purchases.

10.2

Continued use of Digital Craft after updated Terms take effect may constitute acceptance of the revised Terms for future use of the service where permitted by applicable law. Where a specific change requires separate User consent, DIGITALCRAFT Sp. z o.o. will request that consent separately.

SUPPORT THE CREATOR PROGRAM AND PROGRAM FUNDS

DIGITALCRAFT Sp. z o.o. may offer a “Support the Creator” program under which a buyer may indicate a preference to support the creator of a particular asset. Any buyer payment remains collected by DIGITALCRAFT Sp. z o.o. as the seller and contracting party; the buyer does not transfer funds directly to the creator, and the creator does not become the seller, recipient of the card payment or contracting party with the buyer.

11.1

Creator or supplier remuneration under the program is calculated and paid separately by DIGITALCRAFT Sp. z

o.o. under the relevant Creator/Supplier Agreement or other contractual terms between DIGITALCRAFT Sp. z o.o. and the creator/supplier.

Such payments are separate obligations of DIGITALCRAFT Sp. z o.o. to the creator/supplier and do not constitute a transfer of the buyer’s specific card payment to that creator/supplier. Payments are made only after required payment and identification information has been provided and verified.

11.2

If a creator or supplier does not provide valid information necessary for identification or payment, DIGITALCRAFT Sp. z o.o. may suspend the relevant remuneration until verification is completed or act as provided in its contract with the creator/supplier and applicable law. Payments to third parties or unverified accounts may be restricted or prohibited.

11.3

Refunds and other remedies relating to a purchase are governed by the Payment & Refund Policy and mandatory law. These Terms constitute the entire agreement between you and DIGITALCRAFT Sp. z o.o. concerning your use of Digital Craft and its assets, replacing prior agreements on the same subject, except for documents expressly incorporated into these Terms and liability that cannot lawfully be excluded.

12.2

If DIGITALCRAFT Sp. z o.o. does not exercise a legal right or remedy available under these Terms, that does not constitute a waiver of the right or remedy.

12.6

DIGITALCRAFT Sp. z o.o. may transfer or assign its rights and delegate obligations under these Terms to the extent permitted by applicable law, provided that mandatory consumer rights are not adversely affected.

12.7

These Terms and your relationship with DIGITALCRAFT Sp. z o.o. are governed by the laws of the Republic of Poland, without regard to conflict-of-laws principles.

If the User is a consumer, this choice of law does not deprive the User of mandatory protection afforded by the law of the country of the User’s habitual residence where such protection applies.

The parties are encouraged to attempt to resolve disputes through direct negotiations first. If a dispute is not resolved amicably, it may be submitted to a competent court in accordance with applicable law. Nothing in this clause restricts a consumer’s right to contact a competent court, supervisory authority or consumer-protection body.
